Neymar Jr é absolvido pela Justiça da Espanha em processo envolvendo transferência para o Barcelona
A Justiça da Espanha divulgou nesta terça-feira (13) que Neymar Jr, seus pais, a NN Consultoria, além de dirigentes do Santos e do Barcelona, foram absolvidos no processo em que eram acusados de supostas irregularidades na transferência do clube brasileiro para o Barcelona, em 2013.
Em outubro deste ano, o próprio Ministério Público espanhol – baseado em provas, já havia retirado as acusações contra o atleta. Na ocasião, a promotoria pediu ainda que todos os réus envolvidos no processo fossem absolvidos, decisão agora confirmada pela Justiça.
O comunicado emitido pelo tribunal da Audiência de Barcelona destaca: “A audiência absolve Neymar e os demais processados por corrupção entre particularidades e fraude”.
A acusação inicial contra Neymar Jr, seus familiares e os dirigentes se pautava exclusivamente nas versões unilaterais, particulares e angularizadas do grupo DIS, que foram totalmente rejeitadas após a regular instrução. Além do total insucesso, a acusação particular, o grupo DIS, ainda foi condenado ao pagamento das custas processuais a todos aqueles que foram indevidamente acusados.
O desfecho comunicado pela Justiça da Espanha segue a mesma posição que também já havia sido oferecida pela FIFA e pelo Tribunal Arbitral do Esporte (CAS), órgãos máximos em matéria de futebol. Ambos já tinham se pronunciado, reconhecendo a legalidade da transferência, em decisão definitiva, transitada e julgada.

Neymar Jr. was absolved by the Spanish Court in a process involving the transfer to Barcelona
The Spanish Court announced on this Tuesday (13) that Neymar Jr., his parents, the NN Consultoria company, in addition to Santos and Barcelona directors, were all absolved on the process in which they were accused of alleged irregularities on the transfer from the Brazilian club to Barcelona, back in 2013.
In October of this year, the Spanish public prosecution itself – based on proof, had already dropped all charges against the athlete. On that occasion, the prosecution demanded all defendants involved in the process to be absolved, decision now confirmed by the Court.
The statement released by Barcelona’s Court Hearing points out: “the audience absolves Neymar and the others processed for corruption between individuals and fraud.”
The initial accusation against Neymar Jr., his family and the directors was exclusively based on unilateral, individual and angular versions from the DIS group, which were totally rejected after regular instruction. Besides the utter underachievement, the particular accusation, the DIS group, was also sentenced to pay the trial costs of all individuals wrongfully accused.
The outcome communicated by the Spanish Court follows the same position already taken by FIFA and the Court of Arbitration for Sport (CAS), supreme bodies when it comes to football. Both of them had already made statements recognizing the transfer’s legality, in a definitive decision, res judicata.
